Department of Housing and Urban Development Washington, D.C. 20410-8000 May 15, 1995 OFFICE OF THE ASSISTANT SECRETARY FOR HOUSING-FEDERAL HOUSING COMMISSIONER Mortgagee Letter 95-21 TO: ALL APPROVED MORTGAGEES SUBJECT: Single Family Loan Production - Compliance with the Handicapped Accessibility Requirements of the Fair Housing Act This Mortgagee Letter is to remind lenders, sponsors, builders, developers, architects, and executives of condominium associations that handicapped accessibility requirements are still in effect. If applicable to your building, you must be in compliance with them. If you have a dwelling unit in a "covered multifamily dwelling" with a mortgage insured under any of the Department's single family programs that have handicapped accessibility design and construction requirements, you are required to continue to comply with the Fair Housing Act that specifically affects multifamily dwellings and their dwelling units. Program participants are responsible to insure that their projects conform to the handicapped accessibility requirements. Specifications on the requirements for "covered multifamily dwellings" and their dwelling units can be found under Section 804(f)(3)(c) of the Fair Housing Act.
