The information on this page is in support of the PRA submission for OMB Control Number 2502-0612, to update the ICR for Rental Assistance Demonstration (RAD) and the Supporting Contracts and Processing Requirements for these documents. The information collection contained herein supports two activities: first, it includes the related contract documents that awardees will sign as part of the conversion process that memorialize agreements between HUD and parties to ensure the application of legal requirements and, second, it includes the associated program submission requirements for awardees prior to or following conversion for HUD to ensure compliance with program requirements.
HUD is requesting comment from all interested parties on the proposed collection of information. The public comments are due June 18, 2021, which is 30 days after the date of publication in the Federal Register. Interested persons are invited to submit comments and should refer to this collection by OMB Control Number (2502-0612) and should send comments by email to Colette.Pollard@hud.gov. The following documents will be submitted by Public Housing Authorities (PHAs) and Owners to The Department for evaluation.
- RAD Application Form (HUD 5893): The application is used to determine program eligibility and provide information to make an initial award.
- RAD Conversion Commitment Public Housing First Component (HUD 52624): This document acts as official HUD approval of a PHA and Owner financing plan and details the terms and conditions of the conversion agreement between HUD and the PHA.
- RAD First Component HAP Contract for the Conversion of Public Housing to Section 8 Project-Based Vouchers (PBV) Part I (HUD 52621A) and Part II (HUD 52621B): PHAs will use this contract (Part I and Part II) at the completion of a RAD conversion of Public Housing to PBV. The contract dictates the terms under which housing assistance payments will be made.
- RAD First Component HAP Contract RAD for the Conversion of Public Housing to Project-Based Section 8 (PBRA) Part I (HUD 52620A) and Part II (HUD 52620B): HUD will use this contract at the completion of a RAD conversion of Public Housing to Project-Based Section 8 (PBRA) The contract dictates the terms under which housing assistance payments will be made. Note: this had previously been referred to under the form numbers HUD 52620 and HUD 52618
- RAD First Component Use Agreement (HUD 52625): This document sets out affordability and use restrictions for converted projects.
- RAD/Section 18 Blend Rider to RAD Use Agreement (HUD 5900): This document sets out affordability and use restrictions for projects approved through Section 18 in conjunction with RAD and that will be preserved with project-based assistance.
- Counsel Opinions - PHA Counsel (HUD 5890) | Project Owner Counsel (HUD 5892): These documents provide evidence to HUD that claims made are reliable.
- RAD Transfer of Assistance Covenants (HUD 5887): This document sets out affordability and use restrictions for properties released from the public housing Declaration of Trust to ensure the land or proceeds generated from the land are used for affordable housing.
- Contract Administrator Funding Survey (HUD 5888): This information is necessary to ensure PHAs have the appropriate resources needed to meet funding commitments under new HAP contracts.
- Submission of Interest - Mod Rehab (HUD 5902) and PRAC (HUD 5903): This information is necessary in order to direct the owner to appropriate technical assistance as the initiate the conversion process.
- RAD Rider to the Section 8 Project-based Voucher (PBV) Housing Assistance Payments (HAP) Contract for Existing Housing (Rent Supplement, Rental Assistance Payment and Section 8 Moderate Rehabilitation Program Conversions; Second Component) (HUD 52611): This Rider is to be executed between the Public Housing Agency (PHA) and the owner of an eligible project in connection with HUD approval of the use of tenant-protection vouchers issued under section 8(o) of the United States Housing Act of 1937 (1937 Act), for PBV assistance under RAD. This Rider is used when the project qualifies as PBV “existing housing” under 24 C.F.R. § 983.3 and must be attached to PBV HAP Contract for Existing Housing (HUD 52621A).
- RAD Second Component Housing Assistance Payments (HAP) Contract RAD for the Conversion of Moderate Rehabilitation to Project-Based Section 8 (PBRA) Part I (HUD 52619) and Part II (HUD 52617): HUD will use these contracts (Part I) at the completion of a RAD conversion of Mod Rehab to Project-Based Section 8 (PBRA) The contract dictates the terms under which housing assistance payments will be made.
- RAD Second Component Rent Supplement Program (RAP) Project-Based Section 8 (PBRA) Housing Assistance Payments (HAP) Contract Part I (HUD 5977) and Part II (HUD 5978): HUD will use these contracts (Part I) at the completion of a RAD conversion of Rent Supp or RAP to Project-Based Section 8 (PBRA). The contract dictates the terms under which housing assistance payments will be made.
- RAD Second Component Project Rental Assistance Contract (PRAC) Project-Based Section 8 (PBRA) Housing Assistance Payments (HAP) Contract Part I (HUD 5896) and Part II (HUD 5897): HUD will use these contracts at the completion of a RAD conversion of PRAC to Project-Based Section 8 (PBRA). The contract dictates the terms under which housing assistance payments will be made.
- RAD Section 8 Project-based Voucher (PBV) Housing Assistance Payments (HAP) Contract for Existing Housing (PRAC; Second Component) Part I (HUD 5898) and Part II (HUD 5899): HUD will use these contracts at the completion of a RAD conversion of PRAC to PBV, the contract dictates the terms under which housing assistance payments will be made.
- RAD PRAC Approval Letter Template: This document serves as a conditional approval of the request to convert a Section 202 Project Rental Assistance Contract. Note: This document is not a part of the PRA document collection, however, it serves as a context for other documents, particularly, the PRAC Conversion Agreement listed below.
- PRAC Conversion Agreement (HUD 5895): This document acts as official HUD approval of an Owner’s Conversion Plan and details the terms and conditions of the conversion agreement between HUD and the Owner.
- Elderly Housing Use Agreement (HUD 5894): This document sets out affordability and use restrictions for converted projects. HUD will use this document in support of the RAD conversion and the official documentation therein.
- Mod Rehab Owner Information (HUD 5889): This document sets out affordability and use restrictions for converted projects. HUD will use this document in support of the RAD conversion and the official documentation therein.
- PRAC Counsel Opinion PRAC (HUD 5904): These documents provide evidence to HUD that claims made are reliable.
- RAD Financing Plan and Conversion Plans (HUD 52614): The PHA or owner’s financing plan or conversion plan demonstrates the availability of resources adequate to address all current and ongoing capital needs of a project identified in a Capital Needs Assessment and to ensure compliance with all program requirements. The plan is evaluated to ensure the long-term physical and financial viability of the Covered Project. Sample RAD Fair Housing, Civil Rights, and Relocation Checklist (HUD 5901), PHAs can use the templates provided in order to submit required information so that HUD can perform certain up-front civil rights reviews as described in the RAD Fair Housing, Civil Rights, and Relocation Notice and in order to assess compliance with RAD relocation requirements.
- Addendum to the HAP Contract – Labor Standards (HUD 5679): This document is used for both the Project-Based Voucher (PBV) HAP Contract and the Project-Based Rental Assistance (PBRA) HAP Contract under RAD for conversions under either the first component (public housing) or second component (Mod Rehab, Rent Supp, RAP, and PRAC) and applies certain labor standard requirements for all construction or repair work on projects that are initiated within eighteen (18) months after the effective date of the HAP contract.
- Post-Closing Completion Certification Rehab (HUD 5891) | No Rehab (HUD 5886): This information is necessary in order to monitor compliance with requirements agreed to as part of the conversion, including the completion of any rehabilitation or construction.
