Guidance on Automation of Capital Fund Program 5-Year Action Plans and Budgets in the Activity Planning Module of HUD’s Energy Performance and Information Center (EPIC) - This notice modifies the submission process for Capital Fund Program (CFP) 5-Year Action Plans (5YAPs) and Budgets (formerly referred to as Annual Statements).

2 CFR 200.311(c)(1) Disposition Instructions for the Public Housing Agency (PHA) Retention of Certain Public Housing Real Property (that is no longer used or was never used for public housing dwelling purposes) Free from Public Housing Use Restrictions - 2 CFR 200.311(c)(1) provides that when real property acquired or improved under a Federal award is no longer needed for the originally authorized purpose, non-Federal entities (e.g., PHAs) must obtain “disposition instructions” from the Federal awarding agency (e.g., HUD) that provide for the retention of title after compensating the Federal awarding agency.

Public Housing Operating Subsidy Eligibility Calculations for Calendar Year (CY) 2017 - This notice provides public housing agencies (PHAs) with instructions for the calculation of Operating Subsidy eligibility for CY 2017.

Guidance on Full Flexibility for Eligible Small PHAs - This notice provides guidance on the “full flexibility” of Capital Funds (capital funds) and Operating Funds (operating funds) for public housing agencies (“PHAs”) which own or operate less than 250 public housing units (“small PHAs”) and meet other requirements. The full flexibility articulated in this notice allows eligible small PHAs to undertake larger project improvements with capital or operating funds while promoting local discretion in prioritizing capital and operational needs.

Guidance on Reporting Public Housing Agency Executive Compensation Information for Calendar Year 2015 - This notice provides information and guidance on how public housing agencies (PHAs) are to use the recently revised HUD-52725 form to report executive compensation.

Amendment - Public Housing Operating Subsidy Eligibility Calculations for Calendar Year 2015 - This Notice amends Notice PIH 2014-19, “Public Housing Operating Subsidy Eligibility Calculations for Calendar Year 2015” (issued on August 19, 2014), by deleting Section 4 of Notice PIH 2014-19 which described a PHA deadline for obligating funds.

Guidance on the Public Housing Agency (PHA) salary restriction in HUD’s annual appropriations - This notice both supersedes PIH 2012-14, “Guidance on Public Housing salary restrictions in HUD’s Federal Fiscal Year (FFY) 2012 Appropriations Act (P.L. 112-55)” (issued February 24, 2012) and provides guidance to Public Housing Agencies (PHAs) regarding the provision in HUD’s annual appropriations that limits the use of Section 8 Tenant-Based Rental Assistance and Section 9 Public Housing Assistance funds to pay salaries (including any bonuses) to PHA employees, including chief executive officers, other officials, and any other employees.

Guidance on Property and Casualty Insurance Issues - This notice provides guidance regarding procedures to be followed in the event of a casualty, as well as use restrictions, reporting requirements on insurance proceeds, and eligible uses related to casualties for Operating or Capital Funds.

Funding Availability for Tenant-Protection Vouchers for Certain At Risk Households in Low-Vacancy Areas – Fiscal Year 2016 - HUD is making up to $5,000,000 available for Tenant Protection Vouchers (TPV) for certain at-risk households in low-vacancy areas for Fiscal Year (FY) 2016.

Set-Aside Funding Availability for Project-Basing HUD-VASH Vouchers - This notice announces the availability of a set-aside of approximately $15 million in HUD-VASH funding that will support approximately 2,000 units of project-based voucher (PBV) assistance.

Housing Choice Voucher (HCV) Family Moves with Continued Assistance, Family Briefing, and Voucher Term’s Suspension - This notice updates previous guidance relating to family moves with continued assistance and incorporates other related changes resulting from publication of the rule “Housing Choice Voucher Program: Streamlining the Portability Process” (hereafter portability rule) (80 FR 50564, published in the Federal Register on August 20, 2015).

Inventory Management System/PIH Information Center (IMS/PIC) Family Self-Sufficiency (FSS) Reporting and FSS Program Portability Provisions - The purpose of this notice is to provide information to PHAs on how to improve the accuracy of the FSS information submitted into IMS/PIC.

Extension — Total Development Costs (TDC) for Affordable Housing under the Native American Housing Assistance and Self-Determination Act of 1996 (NAHASDA) - The purpose of this Notice is to extend the program requirements of PIH Notice 2015-09 dated June 4, 2015, and transmit the updated schedule for the maximum amount of funds that may be used for affordable housing under NAHASDA.

Streamlining Administrative Regulations for Programs Administered by Public Housing Agencies - This Notice presents implementation guidance for provisions included in the regulation titled “Streamlining Administrative Regulations for Public Housing, Housing Choice Voucher, Multifamily Housing, and Community Planning and Development Programs,” also known as the “streamlining rule.”

Implementation of the Federal Fiscal Year (FFY) 2016 Funding Provisions for the Housing Choice Voucher Program - This Notice implements the Housing Choice Voucher (HCV) program funding provisions of the Consolidated Appropriations Act, 2016, (the Act) (P.L. 114-113) referred to hereafter as “the 2016 Act,” enacted on December 18, 2015.

PIH 2016-02

Enhanced Voucher Requirements for Over-housed Families - This Notice supersedes Notice PIH 2008-12 which sets forth the enhanced voucher policies that are applicable to families residing in units where the actual number of bedrooms exceeds the family unit size for which the family qualifies under the public housing agency (PHA) subsidy standards (i.e., “over-housed families”).

Family Unification Program and Family Self Sufficiency Demonstration - Public Housing Agencies (PHAs) have the opportunity to participate in a demonstration testing the effectiveness of combining housing choice vouchers for eligible youth lacking adequate housing under the Family Unification Program (FUP) with assistance under the Family Self Sufficiency (FSS) program.
