Effective Use of the Enterprise Income Verification (EIV) System's Deceased Tenants Report to Reduce Subsidy Payment & Administrative Errors -This Notice explains the procedures Public Housing Agencies (PHAs) are required to implement to deal with families with deceased household members. The implementation of the procedures outlined in this Notice will ensure that PHAs submit accurate data to HUD via the Public and Indian Housing Information Center (PIC) and that PHAs do not make subsidy overpayments on behalf of deceased single member households. Where overpayments have been made, the PHA will recoup the overpayment from the landlord/owner of the rental property under the programs noted in Section 3 of this Notice, with the exception of the Public Housing program.

Extension of the Disaster Voucher Program (DVP) - This notice informs DVP administering public housing agencies (PHAs) that the DVP has been extended beyond the previously projected end date of December 31, 2009, for all pre disaster public housing, project-based, homeless and special needs housing families currently receiving DVP assistance. The purpose of this extension is to allow adequate time for families eligible for tenant protection vouchers (TPVs) or vouchers provided through the Supplemental Appropriations Act for Federal Fiscal Year (FFY) 2009 to transition to the Housing Choice Voucher (HCV) program. HUD has been working with PHAs to assist displaced families in finding permanent housing solutions.

This Notice provides detailed instructions to public housing agencies (PHAs) in Louisiana and Mississippi who are eligible to combine Housing Choice Voucher and public housing operating and capital funds under section 901 of 2006 emergency supplemental appropriations, on how to submit calendar year (CY) 2009 Notices of Intent and Fungibility Plans. This flexibility was extended by 2008 emergency and supplemental appropriations to include CY 2006, 2007, 2008 and 2009. This notice provides guidance on public housing agency (PHA) administrative responsibilities related to portability moves. Specifically:

a. It changes the deadlines by which initial billing information must be submitted by the receiving PHA;
b. It requires the receiving PHA to now provide annual re-certification notification to the initial PHA;
c. It establishes new requirements to address late billing payments by initial PHAs, including an explicit deadline by which on-going monthly billing amounts must be received by the receiving PHA;
d. It outlines the procedures that will be used to transfer units from initial PHAs to receiving PHAs in cases where billing deadlines are not met;
e. It describes penalties that will be imposed on receiving PHAs that fail to provide timely notification to initial PHAs when billing arrangements are terminated;
f. It transmits a revised Family Portability Information Form HUD-52665, which incorporates the new billing deadlines;
g. It clarifies Public and Indian Housing Information Center (PIC) data entry related to portability.

This Notice implements changes to the funding of the Housing Choice Voucher Program resulting from the Federal Fiscal Year (FFY) 2004 Consolidated Appropriations Act (Public Law 108-199), which was signed into law on January 30, 2004. In this law, Congress modifies the method of calculating renewal funds, appropriates funds for Housing Assistance Payments (HAP), public housing agency (PHA) administrative expenses, and a central fund, and prohibits the use of FFY 2004 funds for over-leasing.
