60 Day Notice of Proposed Information Collection: Inspector Candidate Assessment Questionnaire. To meet the requirements of the Uniform Physical Condition Standards (UPCS), the Physical Condition of Multifamily Properties and the Public Housing Assessment System (PHAS) rules, the Department conducts physical condition inspections of approximately 14,000 multifamily and public housing properties annually. To conduct these inspections, HUD uses contract inspectors that are trained and certified in the Uniform Physical Condition Standards protocol by HUD. Individuals who wish to be trained and certified by HUD are requested to electronically submit the questionnaire via the Internet. The questionnaire provides HUD with basic knowledge of an individual's inspection skills and abilities. As part of aligning REAC inspections, state Housing Finance Agencies may also fill out the form for informational purposes only. Comments Due Date: March 2, 2015

The HUD form 52768 (ROSS SERVICE COORDINATORS—FUNDING REQUEST) has been revised to add clarifying questions regarding two application types: Resident associations and nonprofit organizations and the form has been somewhat reformatted. Minor formatting changes were made to the HUD form 52769 (ROSS SERVICE COORDINATORS—NEEDS and SERVICE PARTNERS). The FSS Funding Request form (Form 52651) was removed from the collection. The OMB approval number for this collection is pending. The information provided by the eligible applicants will be reviewed and evaluated by HUD. The information to be collected by HUD will be used to preliminarily rate applications, to determine eligibility for the Reentry Assistance Program Grant Competition and to establish grant amounts. Waivers and Alternative Requirements for the Family Self-Sufficiency. Previously HUD administered the FSS program as two separate programs—one for Housing Choice Voucher (Section 8) participants and one for Public Housing participants. Consolidated Appropriations Act, 2014 provided, however, that the two programs be merged into one program under a separate line item. The objective of the FSS program is to enable participating low-income families to increase their earned income and reduce their dependency on welfare assistance and rental subsidies. Under the FSS program, low-income families are provided opportunities for education, job training, and other forms of social service assistance, while living in assisted housing, so they can obtain skills necessary to achieve self-sufficiency. PIH 2014-25 (HA) Over Subsidization in the Housing Choice Voucher Program - On September 28, 2007, the Office of Inspector General (OIG) issued a report on over subsidization in the Housing Choice Voucher (HCV) program due to the issuance of vouchers with unit sizes greater than the number of family members in the household. Pursuant to the recommendation of the OIG, the Department issued clarifying guidance on the matter of categorization of live-in aides, other reasonable accommodation issues and corresponding data entry into the Inventory Management System (IMS)/Public and Indian Housing Information Center (PIC) through the notices cited above. Notice PIH 2010-51 extended and revised Notice PIH 2009-22 to explain subsidy standards in regard to live-in aides and their PHA-approved family member/s and data entry in IMS/PIC for family members of live-in aides.

Section 184 Indian Housing Loan Guarantee Program New Annual Premium: To meet projected demand for participation in the Section 184 program for fiscal year 2015, HUD is establishing an annual premium of 0.15 percent of the remaining loan balance until the unpaid principal balance, excluding the upfront loan guarantee fee, reaches 78 percent of the lower of the initial sales price or appraised value based on the initial amortization schedule on all new loans, including refinances. With the establishment of the annual premium, the Section 184 program will now have two sources of funds derived from the borrower (the other being the one-time, up-front loan guarantee fee). Without an annual premium, an appropriation of $8 million for Fiscal Year (FY) 2015 2 would support only about $318 million in new loan guarantee commitments, less than half of the amount the program guaranteed in 2013. Native American Housing Assistance and Self-Determination Act of 1996: Request for Information On June 12, 2013, HUD published a Federal Register document that established the Native American Housing and Self-Determination Formula Negotiated Rulemaking Committee, 2013 (Committee). The purpose of the Committee is to develop regulatory changes to the funding formula for the Indian Housing Block Grant (IHBG) program authorized by the Native American Housing Assistance and Self-Determination Act of 1996. As part of its charter, the Committee is reviewing whether the current data source for the needs variables, which is the U.S. Decennial Census, should be updated or revised. Native American Housing Assistance and Self-Determination Act of 1996: Negotiated Rulemaking Committee Third Meeting: The Native American Housing and Assistance and Self-Determination Act of 1996 (25 U.S.C. 4141 et seq.) (NAHASDA) changed the way that housing assistance is provided to Native Americans. NAHASDA eliminated several separate assistance programs and replaced them with a single block grant program, known as the Indian Housing Block Grant (IHBG) program. The regulations governing the IHBG formula allocation are codified in subpart D of part 1000 of HUD's regulations in title 24 of the Code of Federal Regulations. In accordance with section 106 of NAHASDA, HUD developed the regulations with active tribal participation using the procedures of the Negotiated Rulemaking Act of 1990 (5 U.S.C. 561–570).

Section 184 Indian Housing Loan Guarantee Program Increase in the Loan Guarantee FeeThe Section 184 Indian Housing Loan Guarantee program (Section 184 program) provides access to sources of private financing for Indian families, Indian housing authorities, and Indian tribes that otherwise could not acquire housing financing because of the unique legal status of Indian land, by guaranteeing loans to eligible persons and entities. Over the last 5 years, the Section 184 program has doubled the number of loans and eligible families being assisted by the program. For HUD to continue to meet the increasing demand for participation in this program, HUD is exercising its new authority to increase the loan guarantee fee to 1.5 percent of the principal obligation from the current rate of 1 percent.

Conforming Amendment to the Section 184 Indian Housing Loan Guarantee Program Regulations: This final rule revises the regulations governing the Section 184 Indian Housing Loan Guarantee program (Section 184 program) to conform to a recent statutory change. The 2013 Consolidated and Further Continuing Appropriations Act amends section 184(d) of the Housing and Community Development Act of 1992 by authorizing HUD to increase the fee for the guarantee of Section 184 loans up to 3 percent of the principal obligation of the loan and to establish the amount of the fee by publishing a notice in the Federal Register. This final rule amends the Section 184 Indian Housing Loan Guarantee Program regulations to reflect this new authority.

Guidance on NED Recoding- Section 5.b. of PIH Notice 2013-18 (Revised Policies and Procedures for Special Purpose Housing Choice Vouchers for Non-Elderly Disabled Families and Other Populations) provides that a family that meets the definition of a NED family could be coded as such on the 50058 in order for the PHA to reach its baseline of required NED families. However, once the baseline is established, the PHA must not recode existing participant families as NED when there is turnover. That same section also states that in regard to monitoring leasing through PIC, it will ensure that upon turnover, NED vouchers are issued to other NED families. Issuance can only be accomplished through selection from the PHA's waiting list.

The property representative explains that the properties have common ownership. EPA's tool, the Portfolio Manager, is a free, benchmarking tool that allows users to monitor the utility consumption of the buildings in their portfolio. Exception Payments Standard Guidance: HUD has developed a new methodology for determining exception payment standards above 110% of the established Fair Market Rent (FMR). This methodology is specifically designed for areas which experience significant shocks, such as natural disasters or natural resource exploration, and have a non-functioning rental housing market where the FMRs may be insufficient yet the normal data sources do not capture the conditions on the ground. 

The new methodology tries to estimate the post-shock rental housing vacancy rate as a function of pre-shock rental housing market vacancies. The methodology will focus on estimating the number of additional households looking for housing due to the increased economic activity in the FMR area. Headquarters has also issued guidance on requesting waivers to 24 CFR 982.503(c) to allow a larger exception payment area and/or to allow the PHA to use the alternate PD&R -developed methodology.

Administrative Fee Study: HUD Published a Request in the Federal Register for the clearance of on-site and telephone data collection from PHAs in support of the HCV Program Administrative Fee Study. The purpose of the study is to collect accurate information on the costs of administering the HCV program across a national sample of high-performing and efficient PHAs, and to use this information to develop a new administrative fee allocation formula for the HCV program.

Equal Access to Housing Regardless of Sexual Orientation or Gender Identity: HUD Secretary Shaun Donovan announced new regulations intended to ensure that HUD's core housing programs are open to all eligible persons, regardless of sexual orientation or gender identity. The final regulations, which will be published in the Federal Register next week, are available here and will go into effect 30 days after the publication date.

OPPLI will continue to regularly review all posted forms to ensure that they are current and active.

Fillable and Savable PIH Forms: One of the Delivering Together recommendations was to make all PIH HUD forms fillable and savable. The Department now uses Nuance Software; PHAs that wish to download and save forms to their local drives must first download this software. The steps for downloading the software can be found here.
