Bifurcating Section 8 Contracts Drafting Table
The Bifurcating Section 8 Contracts chapter explains the standards and conditions an Owner must meet to obtain approval from the Office of Multifamily Housing (MFH) to bifurcate a Section 8 Project-Based Rental Assistance (PBRA) Housing Assistance Payments (HAP) contract. It also explains the processing of approved bifurcation requests. This chapter is intended to supersede Notice 2024-03, which was also posted for public comment prior to publication. The chapter differs slightly from Notice 2024-03.
This proposed notice has completed HUD’s internal Departmental Clearance process. The Department is seeking public comment on this chapter.
