Housing Choice Voucher Related PIH Notices

This Notice replaces Notice PIH 2005-7 and highlights the importance of timely and accurate income and rent determinations by Public Housing Agencies (PHAs), and the consequences for failure to identify and correct income and rent determination deficiencies. Also, PHAs will now be required to reimburse HUD 100 percent of disallowed costs for PHA errors identified in the Housing Choice Voucher (HCV) program. [...]

These operating requirements set forth the policies and procedures for the Disaster Housing Assistance Program (DHAP). DHAP is a HUD-FEMA pilot grant program to provide rent subsidies for non-HUD assisted individuals and families displaced by Hurricane Katrina or Hurricane Rita.

Public Housing Agencies (PHAs) that agree to administer DHAP must do so in accordance with these requirements and any subsequent HUD directives and guidance for the program.

This Notice reinstates Notice PIH 2006-32 (HA), which reinstated Notice PIH 2005-9 and provided additional guidance on prudent financial management in the HCV program.

On June 18, 2007, the Department advised public housing agencies (PHAs), through the issuance of Notice PIH 2007-14, Implementation of the Federal Fiscal Year 2007 Funding Provisions for the Housing Choice Voucher Program, of the availability of funds from the $100 million set-aside provided under the Revised Continuing Appropriations Resolution, 2007 (Revised CR 2007). The purpose of this notice is to advise all PHAs of the Department's decision to re-open the application period for requests for funds from the $100 million set-aside provided under the Revised CR 2007 and to extend the period of eligibility for portability and unforeseen circumstances into CY 2007. This notice revises specifically Paragraph 9 "$100 million Set-Aside to Adjust PHA Baseline" of PIH Notice 2007-14.

This Notice informs public housing agencies (PHAs) in Louisiana and Mississippi who are eligible to combine Housing Choice Voucher and public housing operating and capital funds under section 901 of 2006 emergency supplemental appropriations that this flexibility has been extended to include both calendar years (CY) 2006 and 2007. The 2006 appropriations language only allowed fungibility for calendar year 2006.

This Notice extends Notice PIH 2006-26, same subject, which will expire on June 30, 2007, for another year until June 30, 2008. This Notice informs DVP administering public housing agencies (PHAs) that the DVP has been extended beyond its previous sunset date of September 30, 2007. In addition, the time period for the waiver of the normally applicable voucher program tenant rent contribution requirements for DVP families has been changed. The waiver of the tenant’s rent contribution now applies to all DVP families until December 31, 2007.

This Notice reinstates and extends Notice PIH 2002-22, same subject, which expired November 30, 2004, until June 30, 2006.

This Notice expands upon existing guidance provided under Paragraph 5 of Notice PIH 2005-1 (HA), Implementation of the Consolidated Appropriations Act (HR 4818 – H Rept 108-792), 2005 Funding Provisions for the Housing Choice Voucher Program and Notice PIH 2005-14 (HA), Calendar Year 2005 Administrative Fee Funding for Homeownership Voucher Program Implementation and Closings.

Homeownership is a key to financial independence, the accumulation of wealth, and stronger, healthier communities. Increasing homeownership among low-income and minority households is one of HUD's most important 2005 initiatives. The homeownership option under the Housing Choice Voucher Program helps accomplish this objective by allowing public housing agencies (PHAs) to provide voucher assistance to low-income first-time homebuyers for monthly homeownership expenses rather than for monthly rental payments.

PIH 2005-1 (HA)

This Notice implements the Housing Choice Voucher (HCV) Program funding provisions resulting from enactment of the Consolidated Appropriations Act, 2005. In this law, Congress modifies the method of calculating and distributing renewal funds, public housing agency (PHA) administrative fees, and continues to prohibit the use of renewal funds for over-leasing. The Act specifies that calendar year 2005 will be the funding period for such renewals and administrative fees under the HCV program.

This Notice provides guidance to Public Housing Agencies (PHAs) and Project Owners and Management Agents in determining annual and adjusted income in HUD's assisted housing programs under the Medicare Prescription Drug, Improvement and Modernization Act of 2003, Public Law 108-173. This notice has been revised to provide guidance on methods of verification to use in relation to this benefit.

The purpose of this Notice is to inform Public Housing Agencies (PHAs) of the required procedures for verifying social security benefits of applicants, participants and household members during mandatory examination of household income.

This Notice provides instructions on the HUD-established verification policies as provided in the attached Verification Guidance. Administrators of Public Housing and Section 8 programs are required to implement procedures to ensure compliance with these verification policies during mandatory interim and reexaminations of family income under existing regulations.
