The
documents provided on this web page are multifamily documents that were proposed
for update by notice published on August 2, 2004 (69 FR 46214). These documents
reflect revisions following consideration of public comments received in response
to the August 2004, notice, and further consideration by HUD in 2004 and 2005
of various provisions of these documents. On August 31, 2006, HUD published a
notice announcing a meeting to discuss HUD's progress in updating the multifamily
closing documents and advising of policy calls made at that time. (71 FR 31842). This
new HUD Administration has begun its review of these documents to consider changes
that may be appropriate given policy decisions by a new Administration and in
recognition of changes in the multifamily rental housing industry that have occurred
since these documents were first proposed for public comment.
As HUD undertakes its review of these documents, HUD invites its industry partners,
the legal community, and other interested members of the public to review these
documents along with HUD. Information, comments, or changes that HUD should take
into consideration may be sent to the Multifamily
TRACS Working Group. To ensure appropriate consideration of your feedback,
please use the following subject heading: "MF Housing Closing Loan Documents."
Deadline:
Comments on the documents must be received no later than July 1, 2009. In
response to requests, the documents are being made available in "Microsoft
Word" format as well as PDF format. If you choose to submit a modified document
to demonstrate your suggestions, each redline/strikeout change to a document must
be accompanied by a narrative comment to explain the reason for the proposed document
revision.
Note:
Posting of these documents on HUD's website shall not be taken as HUD's formal
proposal for revised documents, but only as an opportunity to review and informally
comment on them at the same time as HUD's internal review is taking place. After
HUD's review has been completed and your comments have been reviewed, HUD then
will formally propose the revised closing documents for public comment. HUD's
official versions of most of these forms, which are currently in effect, are on
HUDclips forms.
