following lists and describes program requirements and guidance
to multifamily housing program users of the EIV system, which contains
confidential information about families participating in HUD's rental
assistance programs. As the Department continues to develop, issue,
and refine program requirements and guidance relative to the use
of EIV, it will update the site. Check this page regularly for continuous
updates.
Privacy
Act of 1974 (5 USC 552a)
Details and describes statutory (mandatory) requirements
for maintaining and using an individual's information (e.g., name,
address, social security number (SSN), wage-related and benefit
information, disability status, etc.) obtained through a computer
matching program between federal and State agencies. This includes
conditions of disclosure, accounting of certain disclosures, access
to individual records, agency requirements (e.g., individual consent,
public notice, safeguards), independent verification requirements,
and more.

FR 10605, Privacy Act of 1974; Notice of a Computer Matching Program
Between the Department of Housing and Urban Development (HUD) and
the Social Security Administration (SSA): Matching Tenant Data in
Assisted Housing Programs, dated March 11, 2009
This Notice informs the public of HUD's intent to enter into a new
computer matching program with SSA in May 2009. HUD will obtain
the SSA data and make it available, in part, to 1) owners and management
agents (O/As) responsible for managing and operating multifamily
housing properties, 2) contract administrators (CAs) responsible
for overseeing O/A management and operation of multifamily housing
properties, and 3) independent public auditors (IPAs) responsible
for auditing both public housing agencies (PHAs) and O/As. Computer
matching began on April 10, 2009.

FR 10046, Privacy Act of 1974; Notice of Matching Program Between
the Department of Housing and Urban Development (HUD) and the Department
of Heath and Human Services (HHS): Matching Tenant Data in Assisted
Housing Programs, dated February 25, 2008
This Notice informs the public of HUD's intent to conduct a recurring
computer matching program involving comparisons of information provided
by participants in public and assisted housing programs authorized
by the agreement and information available in HHS' National Directory
of New Hires (NDNH) database. This Notice, which became effective
on March 26, 2009, provides supplementary information, authority,
program objectives and description, and information regarding tenant
records and program period.

FR 45066, Privacy Act of 1974; Amendment to an Existing System of
Records, Enterprise Income Verification, HUD/PIH-5, dated August
8, 2006
This Notice, which became effective on September 7, 2006, informs
the public that the HUD EIV system of records is being made available
to O/As who administer rental assistance programs for the Office
of Housing and CAs under contract with HUD to oversee O/A administration
of such programs. The EIV system had previously been available to
only PHAs that administer public housing and Section 8 tenant-based
rental assistance programs.

FR 13339, Refinement of Income and Rent Determination Requirements
in Public and Assisted Housing Programs: Delay of Effective Date,
dated March 27, 2009
This Notice informs the public that HUD is delaying the effective
date of the rule entitled, "Refinement of Income and Rent Determination
Requirements in Public and Assisted Housing Programs" published
in the Federal Register on January 27, 2009. This rule, which was
originally scheduled to become effective on March 30, 2009, (except
for the mandatory use of EIV for Multifamily which was originally
scheduled to become effective on September 30, 2009) will become
effective on September 30, 2009, including the mandatory use of
EIV for Multifamily.
Refinement
of Income and Rent Determination Requirements in Public and Assisted
Housing Programs: Proposed Delay of Effective Date, dated February
11, 2009 (24 CFR Parts 5, 92, and 908)
This Notice requests public comment on 1) a 60-day delay in the
March 30, 2009 effective date of the Refinement of Income and
Rent Determination Requirements in Public and Assisted Housing
Programs Final Rule that was published in the Federal Register
on January 27, 2009, and 2) the delayed September 30, 2009 effective
date for the EIV system to be mandatory for multifamily housing
program users, also part of the final rule. The Notice also solicits
comments generally on the final rule itself.
In
addition, clarification is made in the Notice that the final rule
requirements on the use of social security numbers for determining
program eligibility do not apply to individuals in mixed families
who do not contend eligible immigration status under HUD's noncitizen
regulations.
Refinement
of Income and Rent Determination Requirements in Public and Assisted
Housing Programs; Final Rule, dated January 27, 2009 and Proposed
Rule, dated June 19, 2007 (24 CFR Parts 5, 92, and 908)
The Rule revises HUD's public and assisted housing program
regulations to implement the upfront income verification (UIV) process
and to require the use of HUD's Enterprise Income Verification (EIV)
system by public housing agencies (PHAs), multifamily housing owners
and management agents (O/As) when verifying the employment and income
of program participants at the time of all reexamination or re-certifications.
The overall goal of the rule is to ensure that deficiencies in public
and assisted housing rental determinations are identified and cured.
Enterprise
Income Verification, dated June 25, 2008 (HUD Housing Notice
H2008-03)
The purpose of this Notice is to provide guidance to owners
and management agents (O/As) on using the data in EIV for verifying,
at the time of recertification, the employment and income of individuals
participating in one of Multifamily Housing's rental assistance
programs listed in Section II of the Notice. The Notice also provides
guidance for using the various reports by O/As at the time of recertification.
The reports may also be used by Performance Based Contract Administrators
(PBCAs), Traditional Contract Administrators (TCAs), and HUD staff
in monitoring the O/A's compliance with the recertification process.

Resolving
Income Discrepancies between Tenant-Provided and Enterprise Income
Verification (EIV) System Income Data, dated May 2008
Specifies applicable multifamily housing programs and
policies and procedures for verifying and resolving income discrepancies
between tenant-provided and EIV system data. This includes a description
of, and guidance on, how to use the EIV Income Report and Income
Discrepancy Report in calculating and resolving potential discrepancies.
Social
Security Administration (SSA) Form 7004 may be used by the tenant,
or a person authorized to represent the tenant, to request a tenant's
Social Security Earnings Statement in cases where the tenant disputes
the information contained in the EIV system, which is provided by
the SSA and the Department of Health and Human Services (HHS') National
Directory of New Hires (NDNH).
