The Decatur Housing Authority (DHA) exercised a novel approach
with a contractor selected to perform demolition work at its Longview
Place HOPE VI Redevelopment site. The Section 3 utilization plan
established by the contractor designated over $100K of work to be
awarded to a Section 3 business concern. When the contractor indicated
they would not employ a Section 3 business concern as agreed upon,
DHA notified them that all work would be suspended immediately due
to their failure to comply with Section 3. The correspondence outlined
the compliance violation, actions taken, corrective action necessary
to avoid additional sanctions including being held in default of
the contract and a list of certified Section 3 businesses.
Shortly thereafter, contractor submitted a plan for compliance
with Section 3 contracting requirements and executed an agreement
for employing the services of a Section 3 subcontractor. DHA rescinded
the Order of Suspension contingent upon receipt of specified documentation
