Recordkeeping

Under HOME program rules, documents must be kept at least five years. Given the liability issues associated with lead-based paint, it is recommended that records be kept indefinitely. Records to keep include:

  • Receipt of Lead Hazard Information Pamphlet
  • Copies of the Lead Hazard Evaluation and Reduction Notices
  • Evaluation, Lead Hazard Reduction and Clearance Reports
  • Ongoing Maintenance Records

Compliance

Failure to comply with the lead-based paint requirements under the regulation will be subject to sanctions authorized under the Federal funding programs providing assistance to the property, and violations may be subject to other penalties available under state or local law.

Notifying owners, purchasers, or occupants of possible lead-based paint hazards does not relieve grantees of the responsibilities under the new regulation.
