The below summaries provide information on the following: 1) the date the HOME waiver was granted or denied; 2) the State of the local HUD Field Office making the request; 3) the situation which gave rise to the need for a program waiver; and, 4) the regulatory citation. Waiver request granted for the City of Yakima to allow the PJ to provide CHDO set-aside funds to Next Step Housing, which will in turn provide funds to a LLC as owners of the Pear Tree Place apartments. The PJ, CHDO, and the LLC have agreed that Next Step Housing will be the sole managing member of the Pear Tree Place and will have effective project control over its operations. 24 CFR 92.300(a)(1)

Waiver request to invest additional HOME funds in previously-assisted HOME properties denied for the City of New Orleans, a declared disaster area under Hurricanes Katrina and Rita. In order to ensure that HUD has sufficient information on which to base a waiver, HUD requests that the City complete a conditions survey of its HOME-assisted properties and resubmit project-specific waiver requests. 24 CFR 92.214(6)

Waiver request granted for the Texas Department of Housing and Community Affairs (TDHCA) of the HOME regulations regarding housing being the principal residence at time of commitment. TDHCA requested this waiver in response to damage caused by Hurricane Rita to permit homes no longer standing on standing on site at the time of project commitment and whose principal residence, at the time of project commitment, is a unit other than the unit receiving HOME assistance. 24 CFR 92.2
