replacement housing.

for this project. The San Francisco Office had originally objected to the RRF because it appeared
as though the State had signed an agreement with the developer that had legally committed HUD
funds to the project regardless of the outcome of the pending environmental review. OGC concluded
that "the agreement may be considered as not constituting a "commitment of funds" made before
the State requested the release of funds for this project."

disaster relief allocation ($2,650,401.51) from its disaster account to its entitlement account. The State
proposed to use the remaining funds to finance a first-time homebuyers bond program and a homeownership
construction program. HUD found the proposed use of funds to be inconsistent with the purposes for which
the funds were originally appropriated.
